European judges are increasingly encountering Islam in the courtroom. Muslim parties, their attorneys, or the opposing party may argue that the judgment has to take into account the Muslim party‘s culture or religion. However, it can be difficult for judges to assess when and
how it is appropriate to take culture into account. This presentation is based on systematic searches through Danish case law databases, which have identified the various types of cases where Danish judges have been met with such arguments. Among other things, these
cases show that Danish judges have often disagreed on how to handle this cultural element, but also reflect some general trends in the Danish legal approach to such argument. Based on this material, we will discuss the types of arguments European judges might be met
with, as well as the approaches taken by Danish judges.
